These Terms of Service ("Terms") are a binding agreement between you and JobScoutify ("JobScoutify," "we," "us," or "our") governing access to and use of our website, web application, APIs, and related offerings (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
1. Eligibility
You must be at least the age of majority in your jurisdiction (and not younger than 16 where our Services are not directed to minors) and capable of forming a legally binding contract. If you do not meet these requirements, do not use the Services.
2. The Services
JobScoutify provides tools and features that may include, depending on configuration and your account status:
- discovering and browsing job postings (including via third-party job data APIs);
- résumé / CV upload, parsing, editing, and export;
- cover letter and related document generation;
- AI-assisted scoring, suggestions, and analysis (for example, readiness or profile-related insights);
- mock interview / practice style question generation and review flows;
- LinkedIn or profile-related optimization assistance where offered;
- blog and informational content;
- CMS-built pages and navigation elements managed by us; and
- administrative interfaces for authorized operators.
The Services rely on third-party employment data sources, hosting and infrastructure providers, databases and caches, and artificial intelligence models. Features may change, be beta or experimental, or be suspended or discontinued where reasonably necessary for legal, security, operational, or commercial reasons.
3. Accounts and access
Some features may be available without registration. Where accounts exist, you must provide accurate information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of any unauthorized use.
We may apply technical limits (for example, rate limits) to protect the Services and users. Attempts to bypass limits or access non-public administrative areas without authorization are prohibited.
4. User content and license
You retain ownership of content you submit ("User Content"). To operate the Services, you grant JobScoutify a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, and create derivatives (such as parsed fields, structured outputs, or AI-generated text returned to you) solely to provide, secure, improve, and promote the Services, and as described in our Privacy Policy.
You represent that you have all rights necessary to grant this license and that your User Content does not violate law or third-party rights.
5. Acceptable use
You agree not to:
- violate law or third-party rights;
- upload malware, disrupt the Services, or attempt to probe or exploit vulnerabilities except coordinated disclosure we expressly authorize;
- scrape, harvest, or bulk-extract data from the Services in violation of technical barriers, robots.txt (where applicable), or our express permissions;
- reverse engineer or circumvent usage limits except where non-waivable statutory rights apply;
- use outputs to misrepresent qualifications, impersonate others, or deceive employers;
- submit unlawful, defamatory, harassing, hateful, or sexually explicit content, or content that infringes intellectual property;
- use the Services to build a competing product by systematically mirroring our core offering through bulk automated extraction of our UI, data, or documentation; or
- circumvent geographic, rate, or access restrictions we impose in good faith.
We may suspend or terminate access for conduct that threatens users, employers, partners, or infrastructure.
6. AI-generated materials
AI outputs may be inaccurate, incomplete, out of date, or unsuitable for a particular employer, role, jurisdiction, or applicant tracking system (ATS). You must review, fact-check, and edit all materials before submission or reliance.
JobScoutify does not warrant that AI-generated documents comply with any employer rule, law, licensing requirement, or professional standard. You assume all risk from reliance on generated content, including mock practice materials labeled as study aids.
7. Job listings and third parties
Listings and related metadata are supplied by independent data providers, employers, and platforms. We do not endorse employers, guarantee posting accuracy (including compensation or requirements), guarantee availability of listings, or warrant that application links remain valid.
Your application and any hiring relationship are solely between you and the employer or third-party platform. Disputes arising from hiring decisions, interviews, or compensation should be directed to the relevant third party, except where law prohibits exclusion of our liability.
8. Cookies, advertising, and optional scripts
Where we implement them, optional analytics, advertising, or chat-related technologies may load based on your cookie / consent choices and configuration. Your use of those features is also subject to the relevant third-party terms (for example, ad networks or widget providers).
If you disable certain technologies, parts of the Services may not function as intended.
9. Intellectual property
The Services, including software, branding, layouts, documentation, and aggregated presentation of third-party listings (excluding your User Content), are owned by JobScoutify or its licensors and protected by intellectual property laws. Except for limited rights expressly granted, no rights are transferred to you.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, THAT JOB LISTINGS ARE COMPLETE OR CURRENT, OR THAT USE OF THE SERVICES WILL RESULT IN EMPLOYMENT, INTERVIEWS, OR SPECIFIC COMPENSATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBSCOUTIFY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100) IF YOU HAVE NOT PAID US.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
12. Indemnification
You will defend, indemnify, and hold harmless JobScoutify and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of: your User Content; your misuse of the Services; your violation of these Terms; or your violation of third-party rights.
13. Dispute resolution; governing law
These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules. Subject to mandatory consumer protections in your jurisdiction, exclusive venue for disputes will be the state and federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction there.
If you are a consumer in the EEA, UK, or Switzerland, you may benefit from mandatory local rights and venues that cannot be waived; nothing here limits those protections.
Where permitted, you agree that disputes will be resolved in an individual capacity only—not as a plaintiff or class member in any class or representative proceeding.
14. Modification
We may modify the Services or these Terms. We will post updated Terms and revise the "Last updated" date. Continued use after changes become effective constitutes acceptance where permitted by law. If you do not agree, stop using the Services.
15. Termination
You may stop using the Services at any time. We may suspend or terminate access for breach, risk, legal process, or discontinuance of the Services. Provisions intended to survive (including intellectual property, disclaimers, limitations of liability, indemnity, and dispute resolution) survive termination.
16. General
These Terms are the entire agreement regarding the subject matter and supersede prior understandings on the same topic. If a provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign in connection with a merger, acquisition, or asset sale.
